1. About these terms

Welcome to Tiny Moments Co. These Terms of Service ("Terms") apply when you visit our website or buy from us.

"We", "us" and "our" mean Tiny Moments Co (ABN 73 374 058 342), based in Lennox Head, NSW, Australia. "You" means the person using our website or placing an order.

By using our website or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website.

2. Your account and information

You must be at least 18 years old to place an order, or have a parent or guardian's permission.

When you order or create an account, you agree to:

  • give us accurate, current and complete information;
  • keep your login details secure; and
  • take responsibility for all activity on your account.

You may not transfer or sell your account to anyone else.

3. Our products

We do our best to describe and photograph our products accurately. Colours can look different on different screens, and product details may change without notice.

We may limit the quantity of a product per order or stop selling a product at any time.

Please follow the age guidance and care instructions on each product page. Baby and toddler products should always be used with adult supervision.

4. Orders

When you place an order, you are making an offer to buy. We accept your order when we confirm it, and not before.

We may decline or cancel an order, for example if an item is out of stock or a price was shown incorrectly. If we cancel an order after you have paid, we will give you a full refund.

Our products are for personal or household use. Please do not buy them for resale unless we have agreed to this in writing.

5. Prices and payment

All prices are in Australian dollars (AUD). Where GST applies, it is included in the price shown.

The price you pay is the price shown when you place your order. Prices and promotions can change, and promotions may have their own conditions.

Payments are processed securely by Shopify and its payment providers. We never see or store your full card details. By paying, you confirm that you are authorised to use the payment method.

6. Shipping and delivery

We ship within Australia. Our Shipping Policy sets out delivery options, costs and timeframes.

Delivery times are estimates, and carriers can be delayed, particularly at busy times. Risk of loss or damage passes to you when your order is delivered to the address you gave us.

7. Returns, refunds and your consumer rights

Our Refund Policy explains how to return an item and how refunds work.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits those rights.

8. Intellectual property

Everything on our website, including text, images, graphics, logos, product photos and design, is owned by Tiny Moments Co or its licensors and is protected by Australian and international copyright and trademark laws.

You may use our website for your own personal, non-commercial use. You may not copy, reproduce, modify, distribute or republish our content without our written permission.

9. Reviews and feedback

If you send us a review, comment or other feedback, you confirm that you own it and that it is honest and lawful.

You give us a free, non-exclusive, perpetual licence to use, display and publish it, including to promote our business. We may edit or remove feedback that is unlawful, offensive, misleading or breaches these Terms.

10. Acceptable use

You may use our website for lawful purposes only. You agree not to:

  • break any law or infringe anyone else's rights;
  • send spam, malware or misleading information;
  • pretend to be another person or business;
  • scrape, copy or collect data from our website without permission; or
  • interfere with the security or operation of our website.

We may suspend or close your account if you breach these Terms.

11. Third-party tools and links

Our website may use tools provided by third parties and may link to other websites. We do not control these and are not responsible for their content, products or privacy practices. Please read their terms before you use them.

12. Our relationship with Shopify

Our website is powered by Shopify. Any purchase you make is a sale directly between you and Tiny Moments Co.

13. Privacy

We collect and use your personal information as described in our Privacy Policy. Because Shopify hosts our website, some information is shared with Shopify and may be handled in other countries.

14. Errors and changes to information

Sometimes our website may contain typing errors, wrong prices or out-of-date information. We may correct these, update information or cancel an affected order at any time. If we cancel an order you have paid for, we will refund you in full.

15. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits or lost data, arising from your use of our website.

Our website and its general information are provided "as is". We do not promise that it will always be available or error-free.

None of this limits your rights under the Australian Consumer Law or any other law that cannot be excluded.

16. Ending your access

We may suspend or end your access to our website if you breach these Terms. Any parts of these Terms that are meant to continue, such as intellectual property, liability and governing law, will still apply.

If any part of these Terms is found to be unenforceable, the rest still applies. These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, are the whole agreement between you and us about your use of our website and purchases.

If we do not enforce a right straight away, we have not given it up.

18. Changes to these Terms

We may update these Terms from time to time. The latest version is always on this page, with the date it was last updated. If you keep using our website after a change, you accept the updated Terms.

19. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
